Real Estate Listing Agreements
Home Sellers and listing brokers sign a listing agreement prior the property ever being listed for sale. The total commission is negotiated at the time the listing agreement is signed. Let's use an example of 6% total commission. After signing listing agreement, the real estate agent then places the home on the market for sale and markets the property to both buyers and other Austin Realtors.
Austin Board of Realtor and Austin MLS members have buyer agent commission agreements. When the listing agent posts the home for sale on the Austin MLS they offer compensation to whoever brings a buyer to their listing. Using the 6% example, the listing agent usually offers 3% buyer agent compensation. If the buyer is unrepresented, all 6% goes to listing agent, the "Seller's Representative." Realtors will rarely cut their commissions if they are working both sides of the deal. And even if you ask them to do so, they will most likely be relucant to help you during future negotiations. Remember, they do not work for you. the listing agent only owes the buyer honesty and fairness, not negotiations. In other words, they listing agent is playing on the opposites team. Same thing goes for new home sales representatives...
Buying a New Home in Austin
If you choose to buy a new home in the Austin area the builder pays for your representation, not you! Sadly, not many people know this and fewer take advantage of of the free real estate advice that is available to them. It's kind of like if you are accussed of a crime, you are always offered free legal representation from the courts (luckily, buying a home is a much heppier process ;). Only instead of legal representation, you are welcome to use free buyer representation while buying a new home from a builder. Using Buyer Representation does not increase the price of the home nor would you get a better deal if you did not have buyer representation.
